Jones also claims that provisions within the SOE instrument prevent police officers from using it for arbitrary detention. Here's his explanation:

"As in the past as well you would always hear that as a possible complaint and as the commissioner indicated one unit specifically will be dealing with that so that lessens the maybe myself as Pc Bart Jones who has a gripes with someone I would not be able to go and pick up that person and say under the SOE because that only that particular unit the GI3 will be dealing with that and plus the detention orders are signed by the minister and the reasons for detention are signed by myself and so if that person brings someone then clearly I will have to have some history in terms of that persons connection so that is the kind of check and balance we have in respect to the state of emergency which has always been in the past as well."
