His 15-day grace period is up, and Robert Hertular was to have been extradited to the United States tomorrow and he might have been were it not for a last minute filing by his Attorney Michael Peyrefitte.
Peyrefitte is arguing that evidence against Hertular should be brought to court, and if not then he should be released. The application was entered 14 working days after Chief Magistrate Herbert Lord ordered that Hertular should to be extradited to the U.S. to stand trial for conspiring to export drugs to that country. In Supreme Court yesterday Justice Denys Barrow set the 14th July as the date when the matter is to be heard. Peyrefitte has appealed on the grounds that the Chief Magistrate wrongly applied certain sections of the extradition and misuse of drugs acts. Until this is heard, the extradition has again been put on hold pending the outcome of the hearings next month.
