It's the judicial season to get off on murder raps, and today one accused murderer almost got to make his freedom walk down the steps of the Magistrate's Court. We say almost because Fabian Bain who is also known as Carlos Escalante had a murder charge against him thrown out in Magistrate's Court after prosecutors told Magistrate Dorothy Flowers they weren't ready to proceed with a preliminary inquiry. But the 25-year-old didn't get to taste freedom because police simply refused to release him.

Bain was charged for the July 14 2003 murder of Dean Belisle on Oleander Street. He was originally charged along with the notorious Mark "T-dog" Stuart. T-Dog was killed by prison security in his jail cell last year, and in April of this year the charges against Bain were struck out. They were re-instated on May 6th and the preliminary inquiry had been set for today making it the second time he's gotten off on the same charge.
