Two days ago we told you about the police investigation into an allegation of rape made by a woman constable against a senior officer. Well tonight it seems that the senior officer is off the hook, for the time being at least.

The case was perused by the DPP and Officer Commanding National CIB Senior Superintendent James Magdaleno told us today that the DPP has instructed police not to bring charges at this time. But that's not the end of it, Magdaleno says that pending further evidence the DPP may direct charges to be brought at a later date.

As we reported, the complaint was made on Monday night about a rape which is alleged to have occurred in September. But the woman constable did not know the date or time of the rape. Those omissions and the fact that she made the complaint after the senior officer had ordered her transferred, weakened the allegation in the minds of investigators.

But while there are omissions, one observer from the legal community noted to us that under normal circumstances, charges are routinely brought against civilians on the dubious strength of equally unsubstantiated complaints. Those civilians are then left to establish their innocence in court.
