The third person involved in last Friday's shootout with police on Mayflower Street has been charged. 23-year-old Lionel Kelly was in court today to answer to charges of participating in a criminal activity in association with a gang, two counts of aggravated assault with a firearm, and another count of being a member of a gang.

Kelly appeared in front of Magistrate Stephanie Gillett and pleaded not guilty to three of the four charges. Kelly told the court that the charge of being a member of a gang was never read to him by police.

Kelly was remanded into custody and now joins 24-year-old Ainsworth Foreman and a 17-year-old minor. They were jointly charged on Monday with one count of aggravated assault with a firearm and participation in criminal activity of a gang. The minor was also charged with being a member of a gang and was remanded to Wagner's Facility.

The incident occurred on Banak Street, when officers reportedly fired upon the three suspects after they were caught shooting at the base of a rival gang. The three men were injured, and Kelly was shot in the back and the side of his abdomen. He had been hospitalized under police guard. He is due back in court February 13, 2021.
