He was supposed to be a witness for the prosecution in the Sean Menzies murder trial - and it seems that because of that Jaylen Herrera was given immunity from prosecution.

But that witness thing never worked out - because he ended up being a hostile witness who walked back from his sworn statement to police, and allegedly perjured himself in the trial.

And that's why he's in jail tonight. Today, he was taken to court and charged for murder, perjury and perverting the course of justice.

The 20 year old was charged for the murder of Sean Menzies Sr which occurred 3 years ago. - a crime for which two of his associates, Eric Miranda and Jeffery Contreras have already been found guilty.

The DPP's office is saying that when he appeared to testify in the high court he gave an untrue statement under oath.

When asked in court by the Senior Magistrate if he understood the charge and if he had any questions of concern, Herrera who was unrepresented asked, ' How can I get charged for something which two persons have already been found guilty of? "

Notably, during the Menzies trial, another crown witness Iran Jones had testified to seeing Contreras and Miranda running off after the shots were heard in the area and then he testified to seeing one of the men handing over the alleged gun used that day to shoot Menzies. Days later, Iran Jones was found dead in a shallow grave.

Notably, Herrera still has another murder charge pending - for a murder he allegedly committed since the Menzies' killing.
