Darell Tutsi Usher - he was charged for kept firearm and ammunition in 2021 - and tonight the businessman and ex cop is expressing frustration with the multiple delays in the case.
The case was set for final hearing today and Monday - but it was delayed again because the magistrate and the prosecutor could not be in court.
Usher told us the delays are inordinate and burdensome:

"Well, I went to the court this morning, along with my attorney, Mr. Bradley, which is a very expensive attorney. To my surprise, when I reached the Court, they stated that the matter would be adjourned because the sitting magistrate would be sitting on some out district matter."
"While in the courtroom, Mr Bradley will express my dissatisfaction. So today the magistrate stated that the prosecutor, Sergeant Pitts, asked for another adjournment because the magistrate was not in."
"However, the sitting judge then asked for the prosecutor Ms. Elrington, he then stated to her that he was trying to reach Ms Elrington but could not reach her. To me, it's a great injustice because this is going down four years."
"I'm a businessman, so every time I go to court I have to put aside certain business and different things to go the court. In the judge's rule, I think they gave nine months for a case to be tried. I could, yes, the Court is busy, I could give and take, say a year and a half, but going on four years, now."

"It's an abuse, you feel?"

"It is blatant abuse."
Jules Vasquez
"What is the court saying today, since it was set for final and it looked like final change again? What's next?"
Darrell Tutsi Usher
"Well, the judge in the case today, I guess she saw the impression of my face, it's disappointment, right? And she said that, well, its beyond her because she's not a sitting magistrate and the matter has already started, part heard. So it is beyond her and I understand that. However, she said now that she would be setting it for another final.
So now I guess this is the 5th final and up to this date to mentioned I spoke to my attorney and Ms Elrington has still not submit the thing in writing to him so that he could rebut again,"
At the last hearing in February - one of the reasons cited for the delay at that time is because the prosecution claimed Usher is too familiar with the prosecutors for them to work for a conviction.
We asked Usher - who is in the personal loans business - about that relationship:

"That all the prosecutors claim that they know me on a personal level so they do not want to prosecute the matter. I didn't objected to that. I told the court, for one, I don't find it fair to say all prosecutors know because, like a week prior to that, Sergeant Clark had convicted a police officer in his court and sentenced the police officers to jail. So, from my point that's a poor excuse."
