As the mitigation for Selgado drags on, Marlyn Barnes, the woman who accused him of putting a hit her, claims that since the beginning of the case, her life and her family's lives have been overturned due to Salegado's actions. Despite this, Selgado's Attorney says that his client's actions do not warrant the need for a death sentence.

"I certainly empathize with Ms. Barnes and her family. It is regrettable that she's had to endure what she endured. One would have hoped that this never happened. But we are dealing with the reality of what has occurred. It was certainly an issue for her because to have been faced with the prospect of someone hunting you to hurt you, that is a daunting prospect indeed."

"Suffice it to say that at the end of the prosecution's case, the Honorable Justice made his decision. And that's why we are here. So Ms. Barnes can take solace in the fact that the person who was alleged to have committed the offense is now neutralized. In that respect, we can say as human beings the error is human. And there's a possibility that at that time there was an error made by Mr. Salgado in respect of these things."

"Ms. Barnes is alive and well, has the ability to move on from this situation, and we want the same for Mr. Salgado to be alive and well after serving his sentence. Not that his sentence became a death sentence in a facility. When in truth and in fact for the offense committed that would have been to the extreme, the offense does not warrant that sentence."
