As many as 10 defendants were named in the affidavit, several of whom are police officers alleged to be involved alleged to have some kind of involvement in the case. Musa's attorney says only the AG can be named. Still Saldivar feels that an application to strike out the matter is premature. He explained.

The probability that we will see that seems dim now, no not really because this is the reason I am saying that the application to strike out is premature, in the normal course of a trial once case management orders are made there is a requirement for disclosure we haven't even reached that stage we have not even reached the stage of witness statements."
