Jeffrey Prosser and 5 directors from ICC are getting ready to come to a BTL board meeting on Tuesday to re-take control of the company. They believe they can do that because of a judgement given yesterday by Florida Federal Judge Ursula Ungaro Benages. But the dramatic showdown that they are expecting at BTL may not come to pass.
7NEWS has received credible but unofficial reports which suggest that the much anticipated board meeting may be postponed. That would leave the stage set for a Thursday hearing in Miami where both government and ICC will argue over the interpretation of BTL's Articles of Association. To bolster its position in that hearing, Solicitor General Elson Kaseke confirmed that government is going to the Supreme Court next week to request an interpretation of the article that deals with the removal of directors.
It's an important point because it will determine whether Prosser's four directors were properly or improperly removed on February 9th. We should not that even if those directors were rightly removed, Prosser still has two seats on the board and still remains the Chairman even if it does end up that he is in a minority position.
