Today in the Supreme Court, a 48 year old man was sent to jail for raping his pre-teen niece. To protect his victim, we can't tell you the name of the man, but we can tell you that he was sentenced to 18 years for rape.
He had been convicted of rape on October 26th and was given until today to prepare a mitigation plea. But today, undefended, he presented no character witnesses and the only thing he told Justice Michelle Arana was that he was innocent.
The incident occurred in October of 2005 when the his sister who he lived with asked him to oversee her 12 year old girl and son, the man's niece and nephew, while she went out. The girl told police that she was in her mother's bed when the rape occurred. And if the rape wasn't bad enough, in May of this year his bail was revoked after the girl, again his niece, told police that he was stalking her. At that time, the child fainted in front of her school when she saw him.
The case was prosecuted by crown counsel Tracy Sosa.
