Tonight, Lyndon Kelly, a defendant who has been on remand for a little over 5 years on a murder charge is at home. That's after the DPP's Office decided to discontinue their prosecution against him, for now.
Kelly was charged for the September 2016 killing of 32-year-old Elton Polonio. The two allegedly got into some disagreement in Central Park on the island of San Pedro. Reports were that eyewitnesses saw when Polonio received a fatal stab injury in the Park. He reportedly went into a nearby hardware store in search of a machete, and he came back armed. By that time, the injury caused him to collapse, and he was rushed to the San Pedro Polyclinic, where he died while undergoing treatment.
When the case came up today before Justice Herbert Lord, the prosecutor, Romey Wade, informed the court that the DPP's office is forced to enter into a "nolle pros" against Kelly due to insufficient evidence.
With that, Kelly was allowed to leave court free, but the DPP's Office can still bring back the charge against him if they believe they have enough evidence to prove it.
