He was charged for the 2012 shooting of Jermaine "Horse" Garnett, but tonight 34 year-old Gion "Gizmo" Bernard is free of that allegation.

That's because the case was set for trial today before Justice Colin Williams, but Garnett, the complainant who accused Bernard, did not show up to court. So, the judge dismissed the case and informed Bernard that he is no longer charged for this incident. He is a paraplegic, and back in 2012, when he was first charged for this incident, he was also facing charges of wounding and deadly means of harm. Those charges are now also dismissed.

The shooting incident for which he was being accused of happened on April 24th, 2012, near the Freetown Drug Store. Garnett was reportedly sitting in his vehicle, which was parked near the drug store, and he was waiting for his then wife, Pamela Garnett, to return. Garnett reportedly looked into his rear view mirror, and that's when he allegedly saw a man he identified as Bernard, riding by. This assailant reportedly turned around, pulled out a gun, and was attempting to aim it at Garnett.

Garnett reported to police that that he attacked the gunman before he could fire his weapon, and in the struggle over its possession, he suffered a minor gunshot injury to the shoulder.

Garnett reported that he ran toward Kelly Street to avoid being shot further, and that while he was retreating, his attacker kept on fire at him but missed.

Bernard was not represented by any attorney, and Crown Counsel Riis Cattouse represented the DPP's Office.
